INFORMATION GENERAL

These General Terms and Conditions of Sale relate to the purchase of MILITARYGOODS® products made remotely via computer network at www.militarygoods.it , located in Ercolano (NA), Via Panoramica, 314. Each purchase transaction will be governed by the provisions of DLgs. 185/99, DLgs. 206/05; information directed to the conclusion of the contract will be subject to Art. 12 of LD. 70/03 and, as far as the protection of confidentiality is concerned, will be subject to the regulations set forth in LD. 196/03.

CONCLUSION OF THE CONTRACT AND ACCEPTANCE OF THE GENERAL CONDITIONS OF SALE

Contracts for the sale of products on www.militarygoods.it , are considered concluded when the purchase order placed by the customer is received by Militarygoods e The latter accepts it. Militarygoods will promptly send the customer receipt of the purchase order placed by the customer.

The customer, by submitting his purchase order electronically, declares that he has read and accepted these general terms and conditions and undertakes to observe and abide by them in his dealings with Militarygoods.

PROCESSING OF PERSONAL DATA

Militarygoods under Art. 13 of Legislative Decree 196/2003 informs that the personal and tax data acquired even verbally in reference to the business relationships established, provided directly by the interested parties, or otherwise acquired as part of the company’s activities, will be processed in compliance with the regulations referred to, including the obligations of confidentiality provided by them

In relation to the aforementioned may be exercised the rights under Article 7 DLgs. 196/2003.

OBLIGATIONS OF THE CLIENT

The Customer is required, before submitting his/her purchase order, to read these general terms and conditions carefully. Submission of the purchase order implies their full knowledge and acceptance.

Finally, the Customer is obliged, once the online purchase procedure is completed, to print and keep these general conditions of sale, already viewed and accepted during the conclusion of the contract.

ORDER DEFINITION

By placing an order online, the Customer transmits to Militarygoods a proposal to purchase the product and/or products placed in the shopping cart. When the Customer places an online order for the products he or she has placed in the shopping cart, he or she agrees to purchase them at the price and under the terms set forth in these Terms and Conditions.

Militarygoods will notify the Customer of the ‘acceptance and confirmation of the order.

In particular Militarygoods will not accept orders:

  • If the material, at the time of the order was not in stock and/or
  • If the Customer is unable or unwilling to pay using credit cards (Paypal), bank transfer or cash on delivery.

You can place an order either through www.militarygoods.it at the prices and conditions stated therein or at authorized dealers.

MODE OF PURCHASE

The customer purchases the product, the characteristics of which are illustrated online in the relevant descriptive and technical sheets, at the price specified therein, plus the delivery charges specified on the site. (Excludes any charges for cash on delivery payment).

Before the purchase order is submitted, the unit cost of each selected product, the total cost in the case of purchasing more than one product, and the relevant delivery charges are summarized.
Once the purchase order has been submitted, the customer will receive an e-mail message from Militarygoods confirming receipt of the purchase order and containing information about the main characteristics of the purchased goods, details of the price, delivery costs, applicable taxes and means of payment and containing a reference to the general terms and conditions and information about the existence of the right of withdrawal, the conditions and methods of its exercise displayed on the site. Following the approval of Decree Law July 4, 2006 no. 223 “maneuver bis” Art. 37 paragraphs 8 and 9, converted by Law 248 of August 4, 2006, which came into force on August 12, 2006, reinstating the obligation to communicate the list of customers and suppliers in case of invoice issuance, and Decree Law 78 of May 31, 2010 converted into Law 122 of July 30, 2010, imposes the need to require customers to communicate VAT NUMBER and TAX CODE in the appropriate fields on the site.

PAYMENT

The customer can make the payment due by choosing one of the following listed methods.

  • Payment by credit card: In case the consumer intends to make payment by credit card, he/she may use the payment procedure with PayPal, which is suitable for ensuring the confidentiality of data provided by customers. For any information and further Legal Agreements, the Client is referred to www.paypal.com.
  • Cash on delivery payment:Cash on delivery payment is accepted only if made by cash or cashier’s check; consequently, pursuant to and in accordance with Art. 1197 of the Civil Code, payments made by bank check will not be accepted. Cash on delivery payment will be subject to a surcharge that will be communicated to the customer following each order placed. This overcharge is attributable solely and exclusively to the Courier chosen and used by Militarygoods.
  • Payment by bank transfer: Payment by bank transfer can be made using the relevant details given during the purchase process:

In the event that payment is made by bank transfer, the purchased goods will be shipped in the manner set out in the following paragraph “Delivery of Products”, to the address indicated by the customer upon receipt of the credit, then on average within two to five days after making the transfer (timing varies depending on the Credit Institute used). To facilitate the process the payment receipt together with your order number can be sent by e-mail to:info@militarygoods.it.

DELIVERY OF PRODUCTS

The purchased goods, together with the relevant invoice, are delivered by courier to the address specified by the Customer when ordering online. Any specific requirements should be raised by the customer with Militarygoods.

Militarygoods guarantees the delivery of the goods within 15 (fifteen) working days from the date of receipt of the confirmation of ‘transaction. (For payment by cash on delivery, the 15 days will be counted from the date the order is received by e-mail.) In the event that the customer chooses the cash on delivery method, payment must be made exclusively by cash or cashier’s check, to be handed over directly to the courier upon receipt of the goods.

Should Militarygoods, fail to guarantee delivery in the above terms, an additional 10% discount will be applied to the total cost of the MILITARYGOODS® items of reference.

In the case of non-delivery due to the absence of the recipient, at the address indicated by the recipient in the order, the courier will leave a notice and try a second time; if the recipient is still absent, the goods will be returned to the sender (Militarygoods).

WARRANTY OF CONFORMITY AND DEFECTIVE PRODUCTS

Products purchased fromwww.militarygoods.it are subject to the regulations on the sale of consumer goods. Delivered products conform to the characteristics shown online in the relevant descriptive and technical sheets.
Militarygoods is responsible to the customer for conformity defects existing at the time of delivery of the goods.

RIGHT OF WITHDRAWAL

The consumer has the right to exercise the right of withdrawal. In particular, the consumer has the right to withdraw from any contract concluded with Militarygoods, without any penalty and without specifying the reason, within the period of ten (10) ten working days starting from the receipt of the goods.
The right of withdrawal is recognized in the head of the consumer in relation to any goods purchased by him on the site www.militarygoods.it.

MODALITIES FOR THE EXERCISE OF THE RIGHT OF WITHDRAWAL

The right of withdrawal is exercised by sending, within the aforementioned period, written notice to Militarygoods ‘ address by registered letter with acknowledgment of receipt.
Notice of withdrawal may also be sent, within the same period, by telegram or fax, provided it is confirmed by registered mail with return receipt within the following 48 hours.

Where delivery of the good has taken place, the customer shall return it to Militarygoods within the period of 15 (fifteen) working days from the date of delivery of the good.
The item must be returned to Militarygoods complete with all accessories, instruction manuals, and everything originally delivered to the customer, as well as packed in its original wrappings. A copy of the electronic receipt of the order should be attached to the returned product. The cost of returning the goods to Militarygoods is the responsibility of the customer.

If the right of withdrawal is exercised by the customer in accordance with the provisions contained in this clause, Militarygoods shall be obligated to refund the amounts paid by the customer for the cost of the product only.
In particular, Militarygoods will proceed, free of charge, to transmit the re-credit order relating to the cost of the goods shipped including shipping costs within 30 (thirty) days from the date it became aware of the customer’s exercise of the right of withdrawal. This will be done through the issuing credit institution of the credit card used for payment or by crediting the amount to the bank account indicated by the customer.

Militarygoods has the right to reject any product returned by any means other than those specified above, as well as products for which the customer has not fully paid the cost of return, or has not complied with the procedures and timeframes specified for the communication of the exercise of the right of withdrawal.

EXPRESS TERMINATION CLAUSE

In case of non-payment of all or part of the purchase price of the goods Militarygoods reserves the right to declare pursuant to and in accordance with Art. 1456 of the Civil Code terminated this contract by sending a written notice to the customer’s electronic address.

APPLICABLE LAW AND JURISDICTION

This contract is governed by Italian law. The exclusive jurisdiction and venue for any legal action brought by Buyer under this warranty or any additional legal warranties shall be the Court of Naples . If Militarygoods wins in any legal action, the plaintiff shall reimburse Militarygoods for the costs, including attorneys’ fees and court costs, incurred by Militarygoods For its own defense.

RETURN
For anything not expressly provided for in this contract, the rules of current Italian law shall apply.
